Prize Provider Agreement

Phoenix Metalman Recycling is the promoter of a customer promotion entitled “Tradie Clearout Win a Prezzy Card” (Promotion). Phoenix Metalman Recycling (Supplier) agrees to provide the prize(s) for the Promotion on the terms set out in this prize provider agreement (Agreement).

1. ProMOTION AND PRIZE DETAILS

Promotion Period(s)  

Promotion starts 28th November 2023 at 00.01am and closes 11.59pm on 22nd December 2023 

  1. For the duration of the Promotional Period, customers will receive one entry into the prize draw by entering their name and contact details at the time of dropping off metals at any Phoenix Metalman Recycling site and quoting the code ‘CLEAROUT’. For the avoidance of doubt, customers will not be eligible to participate in this promotion if they do not quote this code and enter their name and contact details at the time of drop-off. Entries will not be accepted on a retrospective basis after the time of drop-off.

  • 2. Customers can enter by:
  • (i)  Dropping off any metals and quoting the code ‘CLEAROUT’ at the time (Qualifying Drop-off); and
  • (ii) Entering the name and contact details at the time of drop-off. 
  • (b) Limit of 1 entry per Qualifying Drop-off.
  • (c) Entrants must retain a drop-off receipt for each Qualifying Drop-off as proof of entry. 
  • (d) Entries are deemed to be received at the time of receiving their contact details. Promoter is not responsible for failure to receive any entry for any cause beyond its reasonable control.
  • (e) Entrants must quote a valid code with complete and up to date account details (including phone number) to be eligible to win.

The Promoter may verify the validity of entries and may disqualify entries that do not comply with these terms and conditions.
Prize(s)
  • There will be twenty-five (25) Prizes nationwide. Each Prize consists of a $200 Prezzy Card.

Each prize includes: 

  • 1x$200 Prezzy Card.
  • The Prize will only be delivered to New Zealand and each Winner should allow up to 14 business days from the date of the prize draw for the supplier or suppliers agent to get in touch. 
  • Prize draw will take place w/c 15 January 2024.

2. Provision of Prize(s)

Supplier, Phoenix Metalman Recycling, agrees to provide the Prize(s) to the Winners.

3. Advertising materials

Supplier agrees to provide all reasonably necessary information for the preparation of promotion artwork and advertising materials, as it relates to its contributions to the Promotion, including prize information and value of prizes. Supplier (or its authorized subcontractors) will also contribute to the preparation of artwork and advertising materials for the promotion and will comply with all relevant laws applicable to the performance of its obligations under the Promotion. Both parties agree that such artwork and advertising materials must be approved by both Supplier and the Promoter, prior to final release and publication.

4. Supplier Trademarks

Supplier grants Company a limited, non-exclusive, royalty free licence to use the Supplier trademarks and logos as specified by Supplier (Supplier Trademarks) during the Promotion Period for the purposes of the Supplier performing its obligations under this Agreement and solely in connection with the Promotion. Except as expressly provided in this Agreement, no right, property, licence, permission or interest of any kind in or to the Supplier Trade Marks or any other Supplier intellectual property rights are given, or transferred to, or acquired by, the Promoter.

5. Company Exclusion

If the Promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to, infection by computer virus, bugs, tampering, unauthorised intervention, acts or omissions of third parties, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion. If this occurs, the Promoter will work with the Supplier to conduct the Promotion again at a mutually suitable date.
